Setback for Shahabuddin; Court Rejects Petition

Patna: May 18, 2007

The Patna High Court, on Friday, turned down a petition by the lawyers of Rashtriya Janata Dal (RJD) MP from Siwan Mohammed Shahabuddin who had wished to combine five separate criminal cases against their client into one in connection with the raid at his house in Pratappur back in 2001.

A single bench comprising Justice S. K. Sharma rejected the appeal saying all five cases were completely different in nature and merited separate trials.

Naresh Dixit, the defense lawyer unsuccessfully tried to impress the court that all five cases related to only one incident but over-zealous cops with political vendetta registered five separate FIRs to harass the Siwan MP.

State counsel Harendra Prasad Singh, however, opposed the argument saying all cases were lodged for different crimes and hence, separate trials must be conducted instead of one as proposed by the defense attorney.

The court obviously did not buy Dixit's arguments and rejected the petition.
