Lalu, Rabri Move Supreme Court in DA Case

Rashtriya Janata Dal (RJD) chief and Railway Minister Lalu Prasad Yadav and his wife and former Chief Minister of Bihar Rabri Devi, after being snubbed by the Patna High Court last September, took their cases to the Supreme Court on Wednesday in the disproportionate asset case that were allowed to be reopened after being acquitted by a special CBI court.
Arguing that the state government was not qualified to challenge the CBI court verdict that had earlier exonerated them in the Rs. 46 lakh disproportionate asset case, an offshoot of the multi-crore rupees fodder scam of the '90s, the Yadavs appealed to the apex court to reverse the Patna High Court decision to allow reopening of the cases against them.
"Since the case was thoroughly investigated by the Central Bureau of Investigation (CBI), only the CBI or the Central government had to the constitutional power to challenge the CBI court verdict," the petition said.
While the Yadavs were acquitted by the CBI court, the state government's appeal to reopen the case was held by the Patna High Court as maintainable under Section 378 of the Indian Penal Code.
